Terms of Service (WIP)

By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

1. Important Notice: Please Read First

Klove is not a healthcare provider, and the Service is not a substitute for professional medical care. Klove is an organizational and informational tool. It helps you and your household store, organize, and coordinate health-related information and tasks. It does not provide medical advice, diagnosis, or treatment, and using the Service does not create a doctor-patient relationship between you (or any member of your household) and Klove.

IF YOU THINK YOU OR ANYONE ELSE MAY HAVE A MEDICAL EMERGENCY, CALL 911 (OR YOUR LOCAL EMERGENCY NUMBER) IMMEDIATELY. DO NOT RELY ON THE SERVICE IN AN EMERGENCY.

See Sections 3 and 4 for important details about how the Service โ€” including its AI features โ€” should and should not be used.

2. Eligibility and Accounts

2.1 Age and Capacity. You must be at least 18 years old and able to form a binding contract to use the Service. The Service is currently offered only to users located in the United States.

2.2 Account Registration. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us immediately at [WHAT EMAIL] of any unauthorized use.

2.3 Household Members and Data About Others. The Service allows you to store and manage health-related information about other members of your household, including dependents, aging parents, and minor children. By entering, importing, or managing information about any other person, you represent and warrant that you have the legal right and authority to do so โ€” for example, that you are the individual's parent or legal guardian, hold a valid power of attorney or other legal authority, or have that individual's informed consent.

2.4 Minors. The Service is not directed to, and may not be used directly by, anyone under 18. A parent or legal guardian may store information about a minor child in their own account, subject to Section 2.3 and our Privacy Policy. See the Children's Privacy section of the Privacy Policy for details.

3. What the Service Does, and Does Not, Do

3.1 Description. Klove provides a longitudinal household health record and an AI-assisted layer that helps you organize information, surface non-diagnostic insights and reminders, and coordinate health-related logistics. You remain the decision-maker at all times. The Service is designed to operate at your direction, with you in control.

3.2 Not Medical Advice. Content, summaries, reminders, suggestions, and other outputs provided through the Service โ€” whether generated by Klove staff, by our AI features, or by third parties โ€” are for informational and organizational purposes only. They are not medical advice and must not be used as a substitute for the judgment of a qualified healthcare professional. Always consult a licensed clinician before making any medical decision, starting or stopping any treatment, or acting on any information surfaced by the Service.

3.3 Not Clinical Services. Klove does not practice medicine, nursing, pharmacy, or any other licensed healthcare profession; does not provide clinical care; and does not exercise independent medical judgment. Any concierge or coordination assistance is administrative and logistical in nature.

3.4 No Guarantee of Accuracy or Completeness. Health information is complex and Klove draws on data you provide and data imported from third-party sources. We do not guarantee that any information in the Service is accurate, complete, current, or appropriate for your situation. You are responsible for verifying important information with your healthcare providers and primary records.

4. AI Features: Specific Terms

4.1 Automated Outputs. The Service uses artificial intelligence (including third-party AI models) to generate summaries, organize information, surface insights, and assist with coordination ("AI Outputs"). AI Outputs are produced by automated systems and may be incomplete, inaccurate, outdated, or otherwise unreliable. AI systems can "hallucinate" โ€” that is, produce content that appears plausible but is factually wrong.

4.2 Human Verification Required. You must independently review and verify any AI Output before relying on it, and you must never rely on AI Outputs for medical, diagnostic, treatment, emergency, financial, or legal decisions. Klove does not warrant any AI Output.

4.3 No Autonomous Action Without Your Confirmation. The Service is designed so that consequential actions (such as scheduling, contacting a provider, or sharing your information) require your explicit confirmation. You are responsible for reviewing and confirming such actions.

4.4 How Your Data Is Processed by AI. To provide AI features, your information may be processed by Klove's third-party AI provider(s) under contractual terms that restrict use of your data to providing the Service. Our Privacy Policy describes this processing, including our position on whether your data is used to train AI models.

5. Third-Party Services and Integrations

5.1 Connected Sources. The Service may let you connect third-party sources and platforms to import information. Your use of those third-party services is governed by their own terms and privacy policies, not ours.

5.2 No Responsibility for Third Parties. We do not control and are not responsible for the accuracy, availability, security, or practices of any third-party service, provider, or content. Importing information through a third party is at your own risk, and we disclaim liability arising from third-party services to the fullest extent permitted by law.

6. Your Content and License

6.1 Your Ownership. As between you and Klove, you (or the applicable Household Member) retain all rights to the health-related and other information you submit or import. We do not claim ownership of Your Content.

6.2 Limited License to Operate the Service. You grant Klove a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and use Your Content solely as necessary to provide, maintain, secure, and improve the Service for you, and as otherwise described in our Privacy Policy. We do not sell Your Content, and we do not use it for advertising.

6.3 Feedback. If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use it without obligation to you.

7. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) submit content that is unlawful, infringing, or that you lack the right to submit; (c) access or store information about any person without the authority required by Section 2.3; (d) reverse engineer, scrape, or attempt to extract source code from the Service, except as permitted by law; (e) interfere with or disrupt the Service or its security; (f) misrepresent your identity or authority; or (g) use the Service to provide medical advice to others or to hold yourself out as a healthcare provider.

8. Intellectual Property

The Service, including its software, design, text, graphics, logos, and the "klove" name and marks, is owned by Klove Health LLC or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable, non-exclusive license to use the Service for your personal, non-commercial household use, subject to these Terms. All rights not expressly granted are reserved.

9. Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any information (including AI Outputs) will be accurate, complete, or reliable. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KLOVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, KLOVE'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

11. Indemnification

You agree to indemnify and hold harmless Klove and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) information you submit about any other person without the authority required by Section 2.3.

12. Governing Law and Venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. The exclusive venue for disputes is the state and federal courts located in KING COUNTY, Washington, and you consent to personal jurisdiction there.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable advance notice before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. On termination, the provisions that by their nature should survive will survive. We will handle your data on termination as described in the Privacy Policy.

15. Miscellaneous

16.1 Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and Klove regarding the Service.

16.2 Severability. If any provision is held unenforceable, the rest remains in effect.

16.3 No Waiver. Our failure to enforce any provision is not a waiver.

16.4 Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
